Superstars in Jail
Apr. 11th, 2006 11:19 amIf you are not a Bollywood fan, you have probably not heard of the news that is rocking Bollywood. Salman Khan, one of Bollywood's biggest stars (top three or four, actually), has been convicted to five years of rigorous imprisonment for killing an endangered animal during a hunt in 1998. This in itself, while harsh (it's the maximum sentence which is handed out to habitual poachers), isn't particularly what caught my attention. It's the other, crazy aspects of the case which make me happy that I don't live in India, because the justice system is severely odd. The prosecution's case has been based entirely on a testimony of one witness, who disappeared, with his entire family, four years ago, shortly after giving his statement. There has been a warrant for him, but it expired. Recently, the witness surfaced and said that he's been coerced by police to make this statement and he didn't see SK shoot the animal and that he'd be willing to come and testify. However, the Judicial Magistrate said that since he was so close to issuing his opinion anyway, there was no point in the guy coming in and denied the defence lawyers' requests to have the guy back on the stand. Oh, while he was hunting with a bunch of other actors, none of them have been convicted of anything.
His lawyers are appealing, Bollywood is freaking out (he is one of the most bankable stars, and he was filming a bunch of movies, so there is a lot of money at stake), and the brouhaha is insane.
To add to the fun, the jail he has been taken to after the sentence is apparently one (since it's rigorous imprisonment) which houses scores of terrorists. And Hollywood stars think they have it bad.
I guess they are really zealous to show that 'here, even the high and mighty get punished' and the guy is being made an example of, which I think is bad enough as is, let alone on the non-evidence they seem to have. Also, five years for killing an animal? I would imagine a fine should cover it. Bizarre. But he is pretty likely to be out on appeal so the hoopla is likely to be short-lived.

Thousands of fans of Salman Khan performed a 'Yagya' ( a Hindu ritual of burning wood with 'ghee' for fulfillment of all desires) in Meerut district of Uttar Pradesh . Unable to bear the pain of their favourite Bollywood filmstar falling into troubles one after another, hundreds of Salman Khan fans in Bahadurpur near Meerut, attended a 'Yajna' to make the filmstar's life trouble free, last Saturday.
Chief judicial magistrate of Jodhpur B.K. Jain had on Friday rejected Salman Khan's plea to summon key witness Harish Dulani in court for his deposition in the black buck poaching case .
Justifying his stand judge Jain categorily said that since the judgement of the court would be delivered on April 10 , at the present stage summoning Dulani would not help the cause of the litigation .
As may be recalled , Dulani had been missing for the past four years . Court summons could not be delivered to him as his whereabouts were not known . Last week he suddenly made a public appearance and told a television news channel that he did not see Salman shoot any animal .
The verdict in the case is to be delivered today (April 10) and the non-summoning and re-examination of the key witness Dulani , on whose 2001 statement the verdict of the case rests , makes the outcome obvious and a formality , even to the laymen .

Bollywood star Salman Khan has been sentenced to five years in prison for poaching rare antelope.
The judge in Jodhpur in India's western Rajasthan state also fined Khan 25,000 rupees ($550). An accomplice was given one year in jail.
Khan, who was in court to hear the verdict, has always denied wrong-doing.
He was sentenced to a year in prison in February in an earlier poaching case, but has remained out of custody while he appeals against the verdict.
As camera flashbulbs went off, a visibly shaken Khan was bundled into a police van and taken to Jodphur Central Jail.
His lawyers say he will appeal against the verdict.
"We will file an appeal on Wednesday," Khan's lawyer, Hastimal Saraswat, said.
"I believe our case is strong on merit," he added.
Welcomed
But the verdict has been welcomed by the local Bishnoi community, which worships the black buck, a protected antelope species, and pressed charges against Khan.
"Now no one can dare to kill innocent animals," Mahipal Bishnoi, the lawyer representing the community, said.
Khan, 40, who has a reputation for reckless behaviour, is one of Bollywood's top actors.
He faces two other court cases relating to a hunting trip in Jodhpur in 1998, when two black bucks were killed.
Last week a court rejected his application to summon a key witness who he claims retracted earlier statements that he had seen Khan killing one of the black bucks.
Several other leading actors have also been charged, including actor Saif Ali Khan and actresses Tabu, Neelam and Sonali Bendre, who are accused of accompanying Salman Khan on the illegal hunting trip.
All have denied wrong-doing and said they will contest the charges.

Salman's jail leaves Bollywood shell shocked
Salman Khan's five year jail term has come as a shock to the entire film industry. Many believe that the celebrity tag is hanging like an albatross around Salman's neck.
Ravi Chopra, who had directed Salman Khan in Baghban and was currently busy shooting Babul with the actor, said, "I strongly feel that the celebrity tag that Salman carries with him has made him into a scapegoat. His crime, which is smaller and not all that severe as compared to Jessica Lall’s murder, has been made look like as if it is the crime of the decade.
"While the murderer of Jessica Lall is roaming freely, here is our actor who is facing all the brunt of the law."
"We all have to stand by him and give him support. It is a tough time not only for him and his family but also trying times for everyone in Bollywood. It is true that I, as his producer director of Babul, will be affected along with other filmmakers.
"However, the question of prime importance is how soon can he be released from the jail. It is really a trying time. Honestly, I am not worried about my losses. Rather, I stand by him and am praying hard for his early release."
Producers and directors, who have put in crores in their projects with the superstar, have been left dumbfounded.
Films like Marigold, God tussi great ho, Babul, Salaam-e-Ishq, Partner and many others, which are in various stages of completion, will be badly affected.
According to trade analyst Taran Adarsh, "More than 200 crores is on the actor under various production houses. The loss is not only emotional but monetary as well. It is a loss that we will have to face due to this callous judgement.
"Bollywood is silent and quiet and no one is ready to say anything at this particular time. Some are so sad that they have choked during our telephone conversation."
We have seen celebrities commit crime and then get away with it due to their status. It is just the opposite in Salman's case.
"Law is to be respected, whether one is a celebrity or a common man. It is a professional hazard if you are a celebrity," Adarsh said.

After he was sentenced to five years’ imprisonment, actor Salman Khan was taken to Jodhpur Central prison and lodged in barrack no 1.
He will stay in a 10x10 ft cell that has an attached toilet. Like other convicts, Salman will have only jail food, and will sleep on the floor without a pillow.
A bedsheet and a blanket will be provided at night. While his barrack does not have a television, Salman will be entitled to newspapers. Two guards have been deployed outside his cell round-the-clock. Convicts found guilty of murder occupy the adjacent barracks.
Jodhpur Central prison was built in 1874 and is spread over 46 acres. “Apart from local prisoners, hardcore terrorists and militants from Pakistan, Lebanon, Iran and Afghanistan, who were arrested for carrying out cross-border terror activities, are lodged here,” said Jail Superintendent Mithulal Chauhan. Earlier, a few Hurriyat leaders were also lodged here.
Chauhan, who considers himself a fan of Salman, said, “I like Salman’s performance on screen. But in the prison, he is like any other prisoner and will be treated accordingly.”

Faulty truck saved Salman's life in '98

Shriram Bishnoi, who was in the truck, regrets that the actor escaped the locals' anger
Even though Salman Khan has been sentenced to five years rigorous imprisonment and slapped with a Rs 25,000 fine, the Bishnois of Jodhpur feel that he has got away easy. Given a choice, they would have him dead.
Said Sagaram Bishnoi, the forest officer on duty, when Salman killed two black bucks at the Luni village in Jodhpur on October 1, 1998, “Salman should have been sent to jail for life. If we had got our way, he would have died that night.” Salman is yet to be tried for the case.
After the incident, around 60 Bishnois from Luni had boarded a truck to hunt down Salman and the other stars. Fortunately for Salman, the truck did not start.
We are happy
The investigating officer at the time was Lalit Boda, who has now been replaced by Kishandchand Bhatiji, who said, “If they reached Salman that day, the Bishnois would have surely hurt him badly. We are happy that the law has taken its course and he has been sentenced to five years in jail.”
We’d have killed him
Shriram Bishnoi, who was in the truck that night, said, “It would have been better if we had caught up with them eight years ago. Then we would not have had to wait this long. We would have finished them off right there.”
The Bishnois are a community of nature worshippers, who consider the black buck to be the reincarnation of their Guru Bhagwan Jambeshwar also known as Jambaji. They can even sacrifice their life to save this creature.

Salman Khan spent a sleepless night in the central Jodhpur prison last night, after he was sentenced to five years in jail for killing a chinkara in Jodhpur in 1998. A source from Jodhpur told MiD DAY that Salman had a terrible first night in jail, in a 10x10 cell with no bed or fan.
Earlier in the day, Sallu was in the general cell with people convicted of such crimes as rape and robbery.
When Salman arrived, a few of the inmates were taken aback. “Arre dekho, hero aa gaya. Yeh toh Salman Khan hai... lagta hai isko saza mil gayi,” one of them said, according to a source.
Salman was taken to the jailer’s room, where he was told to take off his shoes, cap, watch, silver bracelet and belt, before he was searched.
At 4 pm, Salman was given tea, which he drank. At around 8 pm dinner was served. It comprised dal, sabzi, four rotis and a cup of rice, but Salman is believed to have refused it.
But the worst was yet to come for the star, who found it difficult to sleep in his cold, bare cell. “It gets quite chilly at night. Salman just had a bedsheet and a blanket, and was pestered by mosquitoes all night. He was given mosquito repellent cream, but it was of no use,” said a source.
“He spent most of the night talking to two guards posted outside the cell, who happened to be fans. Around 4 am he freshened up and offered prayers on the occasion of Eid-e-milad,” the source added.
Family’s worst eid, says Salim Khan
As Salman spent a sleepless night in prison, his mother Salma spent the night at the intensive care unit of Lilavati Hospital.
“She suffered a shock, as she thought that our son would have to spend five years in prison. She is now stable and recuperating. It has been the worst Eid ever for our family. But I am confident that Salman will overcome this. He is a fighter,” said Salman’s father Salim Khan.

New Delhi, April. 11 (AP): Salman Khan may be Jodhpur jail's most famous inmate, but he didn't get the usual VIP treatment that Bollywood stars are accustomed to.
Khan, who was sentenced to five years in prison for poaching a rare buck in a desert wildlife preserve, was dealt with like any other inmate, Prison Director M. L. Chauhan said on Tuesday.
``There was no special treatment,'' Chauhan told reporters outside the jail, a day after a court in Jodhpur, in western India, handed down the verdict.
Khan was fed plain flat bread, vegetable curry and given an earthenware jar of water, like all the other prisoners, Chauhan said.
He was not even allowed to phone his mother Salma, who collapsed and was hospitalized after the verdict, Chauhan said.
``We did not allow him (to call), not as a humane service, not as a VIP. Mobiles (phones) are not permitted,'' he said.
Khan's mother was under observation in Bombay's Lilavati Hospital after she complained of chest pain, the hospital said.
The only concession Khan received was a cell to himself to guarantee his safety, Chauhan said.
Still, that's something in Indian jails, which are notoriously overcrowded with very basic amenities.
Khan will have to spend at least one more night in prison before his lawyers can apply for bail as the courts were closed for two days for local holidays.
Khan has faced several separate charges of poaching and illegal possession of weapons stemming from the incident, when he and several other people allegedly drove into the Thar desert to shoot deer while on a break from filming.
Khan has denied the charges.
Khan, a Bollywood heartthrob, has starred in scores of Hindi-language films, often portraying macho yet romantic characters who fight for love.
Khan is also on trial in a separate case in Bombay for a traffic accident that killed a man in 2002. Three people were injured and one killed when Khan allegedly hit a group of people sleeping on a Mumbai sidewalk.

One thing I hate at the moment is the fact that personal biases come out and Salman-haters are saying, "Finally!" etc - as if he really was convicted because some people don't like his movies. Ridiculous. :/

I guess it's because he seems to be the one Bollywood star who doesn't play media games or presents a moderated image.
Personally, I do like him (he's good-looking, and acts well when he wants), so I hope he gets out of jail and does more movies. For one, I've been waiting for stupid Marigold for years.

Seriously. Hit him with a really hefty fine (they made him pay $550 which is nothing for him), and maybe even make him set up a preserve or something. He can afford it. But jail? And a maximum security one? That's insane.
